Oregon Car Accident Laws

Oregon is a “fault” car accident state, meaning that the at-fault party is financially responsible for the damages stemming from a collision. The injured party could recover financial compensation by filing a claim with their own insurance company (which, in turn, will pursue a subrogation claim against the liable party’s insurer), directly filing a third-party claim with the liable party, or filing a personal injury lawsuit against the liable party.

However, there are many crashes where all parties involved share some blame. Oregon is a “modified comparative negligence” state, meaning an injured party’s award will be reduced their percentage of fault—if their share is not more than the at-fault parties.

For example, if a jury awards you $100,000 in damages, but also believes you are 20 percent responsible for the collision, your total damages will be reduced by 20 percent or $20,000. In the end, your total award is $80,000.
