Colorado Wrongful Death Law

In Colorado, wrongful death laws are governed by a complex set of laws, which cover who can file, what can be recovered, how much time there is to make a claim, and so on. To begin, the laws that decide who can file a claim are restricted based on the amount of time that has passed since the deceased person passed away.

In the first year after the deceased person passed away:

  • The surviving spouse can start a wrongful death claim or lawsuit.
  • The surviving spouse can give permission to a surviving child to start
    the lawsuit instead.
  • The surviving children or named beneficiary can start a claim if they were
    unmarried.
  • The surviving parents can start a claim if the deceased had no spouse,
    children, or beneficiary.

In the second year after the deceased person passed away:

  • The surviving spouse, children, and named beneficiaries can start a wrongful
    death claim or lawsuit, and in different combinations of plaintiffs if
    necessary.
  • The surviving spouse or beneficiary can join a lawsuit previously filed
    by the surviving children.
  • The surviving parents can start a claim if the deceased had no spouse,
    children, or beneficiary.

If two years have passed and no one has started a wrongful death claim, then the court can dismiss any claims filed afterward. The statute of limitations can be extended in rare circumstances, but you should not depend on it.

Damages Available in Wrongful Death Claims

Colorado allows wrongful death plaintiffs to recover economic and non-economic damages in most cases. Economic damages are meant to repay the deceased person’s estate for financial losses. Non-economic damages are meant to accommodate for less tangible losses suffered by both the deceased and the claimants.
