Truck driving along a highway at night, illustrating the risks of fatigued truck driving.

You might assume that fatigued driving and distracted driving are the same thing. But there’s an important distinction. Distraction is a moment. Fatigue is a condition that can persist for miles before a crash ever happens. It is also a condition that carriers and insurers will work hard to conceal.

On the freight corridors running through Minot, including US-83 and Highway 2, commercial trucks move around the clock. When a driver behind the wheel of an 80,000-pound vehicle hasn’t had adequate rest, the consequences can be devastating.

Our truck accident attorneys represent injured people in Minot and Ward County. We’ve recovered over $550 million for clients across North Dakota, and we know how to build fatigue cases that carriers can’t easily dismiss.

Your consultation is free. You pay nothing unless we win.

What Happens When Truckers Drive Fatigued?

Fatigue affects a truck driver the way alcohol does. Reaction times slow, judgment deteriorates, and the ability to respond to changing road conditions breaks down.

In serious cases, fatigued drivers experience microsleep – brief episodes where the brain essentially shuts down for several seconds without the driver realizing it. At 65 miles per hour, a truck travels nearly 100 feet per second. So a five-second microsleep episode means nearly 500 feet of roadway covered with no one in control of an 80,000-pound vehicle. For anyone in that truck’s path, there is no warning and no time to react.

Because of the size and weight involved, crashes caused by fatigued truckers tend to produce more severe injuries than other types of collisions. Speed compounds the damage further.

Fatigue also leaves no chemical trace, which makes these cases harder to prove without the right investigation. Investigators look for signs like a single-vehicle departure from the road, no evidence of braking before impact, and driving patterns consistent with late-night or early-morning fatigue windows.

The Federal Motor Carrier Safety Administration identifies specific hours where drowsiness peaks and driver performance drops most sharply, and those patterns matter when building a fatigue case.

How Often Does Driver Fatigue Cause Truck Accidents?

More often than the industry admits. According to the Federal Motor Carrier Safety Administration, 13 percent of commercial motor vehicle drivers were considered fatigued at the time of a serious crash.

The scale of that problem is significant. According to the National Safety Council, 5,340 people were killed in large truck crashes in 2024, and another 161,201 were injured. Seventy percent of those fatalities were occupants of other vehicles, not the truck itself.

The demands of long-haul trucking make fatigue a persistent problem. Tight delivery schedules, pressure from dispatchers, and financial incentives tied to mileage push drivers to stay on the road longer than regulations allow. Some falsify logs. Some push through exhaustion rather than lose a load. The result is that fatigued driving isn’t an isolated lapse in the trucking industry. It’s a pattern, and the consequences fall on everyone else on the road.

Federal Hours-of-Service Rules and What Violations Look Like

To reduce fatigue-related crashes, the Federal Motor Carrier Safety Administration sets strict limits on how long truck drivers can operate a commercial vehicle. Under current Hours-of-Service regulations, drivers are limited to 11 hours of driving within a 14-hour workday, must take a 30-minute break within the first eight hours of their shift, and are required to take at least 10 consecutive hours off before their next shift. Weekly limits cap driving time at 60 hours over seven days or 70 hours over eight days.

Electronic Logging Devices, required in most commercial trucks, are designed to automatically record a driver’s hours and prevent falsification of records. Before ELDs, paper logbooks were easy to manipulate.

Violations still happen. Dispatcher pressure, tight delivery windows, and financial incentives tied to mileage create conditions where drivers exceed their limits, skip required breaks, or split their off-duty time in ways that don’t provide genuine rest. Some carriers look the other way.

When a violation contributes to your crash, it becomes critical evidence. HOS records, ELD data, and dispatch logs can establish that a driver was operating outside legal limits at the time of the collision, which directly supports your claim.

How We Investigate Fatigued Truck Driver Crashes in Minot

Proving driver fatigue requires more than a police report. It requires getting inside the carrier’s records before they disappear.

When Lowe Law Group takes a fatigued truck driver case, we move quickly to secure the evidence that matters most:  ELD data, driver logbooks, dispatch communications, and maintenance records. These documents can reveal whether a driver was operating outside legal limits, whether a carrier ignored warning signs, and whether pressure from dispatch contributed to the crash.

In fatigue cases especially, this evidence has a short window. Federal regulations only require carriers to retain certain records for limited periods, and some records may be routinely destroyed once retention periods expire unless steps are taken to preserve them.

Our forensic reconstruction team assesses the crash scene and vehicle data to establish exactly what happened and counter any attempt to shift blame onto you. Our in-house medical director, Dr. Andrew Georgi, evaluates your injuries with both your recovery and your case in mind, providing the kind of documentation that holds up when insurers challenge the severity of your claim.

Our Minot truck accident attorneys also know how carriers build their defense, because several of them spent years doing exactly that before joining Lowe Law Group. That experience shapes how we investigate from day one.

Who Can Be Held Liable in a Fatigue-Related Crash

Fatigue-related truck crashes rarely come down to one person’s mistake. Multiple parties can share liability, and identifying all of them is essential to recovering full compensation.

The driver bears direct responsibility for getting behind the wheel while impaired by fatigue. But the trucking company that employed them may also be liable if it set unrealistic schedules, pressured drivers to violate Hours-of-Service rules, or failed to monitor compliance. Third-party logistics companies and dispatchers who dictated delivery timelines can share liability as well, particularly when records show they were aware a driver was approaching or exceeding their legal limits.

Why does this matter to your case? Because each liable party carries its own insurance coverage. A claim limited to the driver alone may leave significant compensation on the table. Building a case that accounts for every responsible party is how we make sure our clients recover what they are actually owed.

Why Minot Clients Choose Lowe Law Group

Fatigue cases are complex. The carrier’s legal team starts building its defense immediately after a crash. You need attorneys who understand exactly how that process works.

Several of our attorneys spent years representing carriers and insurers before joining Lowe Law Group. They know the playbook, and they use that knowledge to stay ahead of it. Our in-house medical director, Dr. Andrew Georgi, documents your injuries in a way that holds up under insurer scrutiny. Our forensic reconstruction team establishes what happened before evidence can be challenged or lost.

We have a local Minot office, a local phone number, and a track record of over $550 million recovered for injured clients across North Dakota, with a 99% win rate. You pay nothing unless we win, and our 30-day risk-free guarantee means you can walk away within the first 30 days with no obligation. We’re available 24/7.
