Fatigue affects a truck driver the way alcohol does. Reaction times slow, judgment deteriorates, and the ability to respond to changing road conditions breaks down.
In serious cases, fatigued drivers experience microsleep – brief episodes where the brain essentially shuts down for several seconds without the driver realizing it. At 65 miles per hour, a truck travels nearly 100 feet per second. So a five-second microsleep episode means nearly 500 feet of roadway covered with no one in control of an 80,000-pound vehicle. For anyone in that truck’s path, there is no warning and no time to react.
Because of the size and weight involved, crashes caused by fatigued truckers tend to produce more severe injuries than other types of collisions. Speed compounds the damage further.
Fatigue also leaves no chemical trace, which makes these cases harder to prove without the right investigation. Investigators look for signs like a single-vehicle departure from the road, no evidence of braking before impact, and driving patterns consistent with late-night or early-morning fatigue windows.
The Federal Motor Carrier Safety Administration identifies specific hours where drowsiness peaks and driver performance drops most sharply, and those patterns matter when building a fatigue case.
More often than the industry admits. According to the Federal Motor Carrier Safety Administration, 13 percent of commercial motor vehicle drivers were considered fatigued at the time of a serious crash.
The scale of that problem is significant. According to the National Safety Council, 5,340 people were killed in large truck crashes in 2024, and another 161,201 were injured. Seventy percent of those fatalities were occupants of other vehicles, not the truck itself.
The demands of long-haul trucking make fatigue a persistent problem. Tight delivery schedules, pressure from dispatchers, and financial incentives tied to mileage push drivers to stay on the road longer than regulations allow. Some falsify logs. Some push through exhaustion rather than lose a load. The result is that fatigued driving isn’t an isolated lapse in the trucking industry. It’s a pattern, and the consequences fall on everyone else on the road.
To reduce fatigue-related crashes, the Federal Motor Carrier Safety Administration sets strict limits on how long truck drivers can operate a commercial vehicle. Under current Hours-of-Service regulations, drivers are limited to 11 hours of driving within a 14-hour workday, must take a 30-minute break within the first eight hours of their shift, and are required to take at least 10 consecutive hours off before their next shift. Weekly limits cap driving time at 60 hours over seven days or 70 hours over eight days.
Electronic Logging Devices, required in most commercial trucks, are designed to automatically record a driver’s hours and prevent falsification of records. Before ELDs, paper logbooks were easy to manipulate.
Violations still happen. Dispatcher pressure, tight delivery windows, and financial incentives tied to mileage create conditions where drivers exceed their limits, skip required breaks, or split their off-duty time in ways that don’t provide genuine rest. Some carriers look the other way.
When a violation contributes to your crash, it becomes critical evidence. HOS records, ELD data, and dispatch logs can establish that a driver was operating outside legal limits at the time of the collision, which directly supports your claim.
