What to Do If You Get Rear-Ended: A Step-by-Step Checklist

Topics in this post

Being rear-ended can feel disorienting, especially in the moments right after impact. Even in crashes that seem minor, the decisions you make at the scene and in the days that follow can have a real impact on your health, your claim, and what you’re ultimately able to recover.

This checklist walks through what to do after a rear-end accident, from the immediate moments at the scene to the steps that protect you in the weeks ahead.

Step 1: Check for Injuries and Move to Safety

Before anything else, take a moment to assess how you feel. Adrenaline can mask pain immediately after a crash, so don’t assume you’re fine just because you don’t feel hurt right away. Check on any passengers as well.

If anyone is seriously injured, call 911 immediately. If the vehicles are drivable and you’re on a busy road, move to the shoulder or a nearby parking lot and turn on your hazard lights. If vehicles can’t be moved, stay inside with your seatbelt on until help arrives.

Step 2: Call the Police and Document the Scene

Call the police even if the damage looks minor. An officer will file a report that becomes important evidence if fault is ever disputed.

While you wait, document as much as you can: photos of both vehicles, the position of the cars, road conditions, visible injuries, and anything else relevant to the scene. If there are witnesses, get their names and contact information before they leave.

When exchanging information with the other driver, keep it factual. Get their name, license, plate number, and insurance details, and avoid any discussion of fault at the scene.

Step 3: Get Medical Attention as Soon as Possible

This is the step people most often skip after a crash that seems minor, and it’s one of the more consequential ones.

Rear-end collisions commonly cause whiplash and other soft tissue injuries that don’t produce noticeable symptoms until hours or days later. Getting evaluated promptly creates a medical record that links your injuries to the accident. If you delay and symptoms emerge later, insurance companies will use that gap to argue your injuries were caused by something else.

Even if you feel okay, visiting urgent care or an emergency room the same day is a reasonable precaution.

Step 4: Notify Your Insurance Company and Watch What You Say to Theirs

Report the accident to your own insurer promptly. Most policies require it, and delaying can create complications.

When the at-fault driver’s insurance company contacts you, be careful. You’re generally not required to give a recorded statement, and early settlement offers are often low. Once you sign a release, you can’t go back for more compensation, even if your injuries turn out to be more serious than they first appeared. Don’t commit to anything before you have a clear picture of your injuries and damages.

Step 5: Document Your Losses and Talk to an Attorney

From the day of the accident forward, keep records of everything: medical bills, missed work, out-of-pocket expenses, and notes on how your symptoms are affecting your daily life. The more thorough your documentation, the stronger your position when it comes time to negotiate.

If you’re unsure what your claim is worth or how to handle the insurance process, a consultation with a car accident attorney costs you nothing and can clarify a lot. Having legal guidance before you make statements or accept offers puts you in a better position regardless of how the case develops.

Who Is at Fault in a Rear-End Accident?

In most rear-end collisions, the driver who struck from behind is presumed to be at fault. Drivers are expected to maintain a safe following distance and be able to stop for slowing or stopped traffic. That presumption can be challenged in some circumstances, but rear-end liability is relatively clear in the majority of cases, which works in your favor when negotiating a claim.
