BACKGROUND
In July 2022, third grader Aryieshah Epps was a passenger in a school van, out on a field trip. The teacher driving the van lost control, over-corrected, and then ran into oncoming traffic. Despite wearing her seatbelt, Aryieshah suffered significant injuries including a skull fracture, concussion, and cuts to her face.
Shateerah Epps, Aryieshah’s mother, tried to communicate with the school’s insurance company, but the conversation went nowhere. As usual, they delayed and deflected, hoping the Epps would give up their case.
Meanwhile, Aryieshah struggled with headaches, back pain, nausea, and poor sleep from night terrors. She couldn’t stay awake in school and had to sit out violin and Jiu-jitsu, her favorite activities. She was in “tears all the time,” recalled Shateerah. “I saw a different side of my baby that I’ve never seen before.” She had no choice but to pull her daughter out of school.
Shateerah tried her best to get medical care for Aryieshah but felt financially squeezed. “I didn’t think I had the money to get her all the support she needed when the medical bills started coming in,” she said. “I took photos of the accident. I called doctors and I tried, but it was very stressful.”
Aryieshah had a long road to recovery, and the insurance company didn’t seem eager to compensate the Epps. Shateerah began to research personal injury law firms with offices in South Dakota.
“I was almost ready to give up. And then when I found Lowe Law Group, it was just like a miracle shift,” Shateerah recalled.
When the Epps hired Lowe Law Group in September 2022, Partner Eric Hinkley and his case team took immediate action. “We were able to obtain Aryieshah’s past medical records, and over the course of our representation, ensure that she attended the proper medical follow-up treatments to minimize the physical damage from her being in this accident, and support Shateerah in helping her get through this process.”
Lowe Law Group’s medical team helped the Epps family find a live-in hospital school in which Aryieshah could continue her education while undergoing intensive rehabilitation. It was not an easy choice for the Epps, but it gave Aryieshah the best chance of recovering.
“It was actually really sad when we went from home,” Aryieshah shared. “I had to see lots of doctors, therapists, but there were some fun parts in it.” The program included activities such as horseback riding and arts and crafts. “The fun stuff kind of took away that sadness. People there were really nice, really sweet.”
A year after her accident, once Aryieshah had reached a stable point in her recovery, Lowe Law Group submitted a demand package to the insurance company. “It’s a way in which we can tell Aryieshah’s story to the insurance company, so they understand what happened and how much it affected this young girl, and not just now, but going into her future,” Eric explained.
After significant back and forth, Lowe Law Group negotiated a settlement worth more than three times what the insurance company initially offered. The win not only relieved the Epps’ medical debt but transformed Aryieshah’s future.
According to Shateerah, her daughter no longer has to worry about “…the generational curse of not going to college because you can’t afford it, or not having a car when you turn sixteen.” She calls the settlement a “generational change” for her family.
RESULTS
While Aryieshah still experiences some symptoms from the accident, she is back in her local school system and doing the activities she loves. In her free time, she advocates for safer driving in her community.
Throughout the case, Shateerah said, “The only cushion we did have was our lawyers, period. We didn’t have any protection, and with them, we were able to receive not just funds—that’s not the major part, and it’s funny because you’d think that’d be the major part—but we received support.”
Often, families struggle to balance the healing process with the grind of obtaining documents, signing paperwork, filing claims, and so forth. Lowe Law Group took on those responsibilities, which gave Shateerah space to be there for her daughter. “I could sit down and not be the person to have to handle this. I could just handle her, and I’m so appreciative of that.”
