Fault vs. No-Fault States

Some states operate on a fault system while others require individuals to handle claims under no-fault standards. Based on how your state operates, the process of filing a claim differs and your rights may be different than you may think.

Fault States

Fault states are those that allow individuals injured in car accidents to file a claim with the insurance company that provides coverage to the responsible party. This means if someone is speeding, crashes into you, and causes injuries, you can file a claim with his or her insurance company to seek compensation.

As with any situation, the other party’s insurance company will not be easy to work with and they may try and find ways to deny your claim. So, even though their policyholder is responsible and fault states require them to help in these situations, they may not be the most willing to do so.

No-Fault States

In no-fault states, the way you file a claim is a lot different. For many minor accidents where property damage is not excessive, you didn’t suffer significant injuries, and you have enough coverage, you will go through your own insurance company regardless of whether the other person caused the accident.

However, legal action may still be necessary in certain circumstances in no-fault states. For instance, if your own insurance company denies your coverage or in accidents involving significant losses and debilitating injuries, you may still file a third-party lawsuit against the responsible party.
