Who Can File a Wrongful Death Claim?

Each state has different laws regarding exactly who can bring a wrongful death claim; in some states, certain surviving family members, dependents, and heirs can file a claim and in others, only the personal representative of the deceased’s estate can bring a claim. That being said, in most states, certain individuals can recover compensation for damages they have suffered as a result of their loved one’s death.
